Fransiskus Xaverius

Frans is an associate in Lubis, Santosa & Maramis Litigation Department. With experience working on legal matters in law firms and government institution, Frans’ area of practice are Commercial Dispute Resolution, Real Estate, E-Commerce & Information, Competition/ Anti-Monopoly, Energy & Natural Resources, Foreign Direct Investment, Joint Ventures and general corporate matters. Frans have had ample experience in assisting in numerous domestic and multi-national companies before Indonesian courts and Indonesian National Board of Arbitration (Badan Arbitrase Nasional Indonesia/ BANI) as well as the out of court debt restructuring, in wide ranging matters from general commercial issues, shipping dispute to intellectual property dispute and others. Frans also regularly engaged in the enforcement of international arbitral awards in Indonesia. Additionally, he has been involved in vast array of projects and deals, such as, foreign direct investment projects, project financing as well as acquisition.

Frans have had ample experience in assisting in numerous domestic and multi-national companies before Indonesian courts and Indonesian National Board of Arbitration (Badan Arbitrase Nasional Indonesia/ BANI)

Organization/Social Contribution

Frans is a member of the Indonesian Bar Association and he has been admitted to practice in Indonesian courts. He is also a member of the Chartered Institute of Arbitrators (CIArb) and a member of Young SIAC (Singapore International Arbitration Centre) Group. In regards with social contribution, in 2021 Frans successfully advocated clean water supply and sustainable access to basic sanitation for Kampung Beting, North Jakarta, which has been facing water crisis for more than 50 (fifty) years. Not only that, Frans has been involved in a number of pro bono cases, including but not limited to probate dispute, apartment dispute and civil registration matters.

Publication

Frans successfully drafted and submitted the academic script and draft of DKI Jakarta Province Regulation on Food Endowment Fund (Dana Abadi Pangan) to Priority Regional Legislation Program (Program Pembentukan Peraturan Daerah) of 2021 and 2022. Frans also involved in preparing a number of draft of Regional Regulations, including, DPRD Regulation on the DPRD Code of Conduct, DKI Jakarta Province Regulation on Corona Virus Disease 2019 Countermeasures, DKI Jakarta Province Regulation on DKI Jakarta Revenues and Expenditures Budget as well as Legal Aid organization regulation. Frans is also the book author of “Hukum di Negara Pancasila” as well as authored an article on “Can or Should the Parties Waive the Right to Set Aside an Arbitral Award?” in participating in YSIAC Writing Competition (2019).

Education

He graduated from Faculty of Law of Parahyangan Catholic University with Magna Cum Laude predicate as well as awarded second most outstanding student from the university. In addition, he also granted with scholarship from Djarum Foundation (Beswan Djarum) and served as the Head of Beswan Djarum Bandung Region.

He speaks Bahasa Indonesia, English, Mandarin and Teochew.

Gilang M. Santosa

Gilang M. Santosa graduated and obtained his Bachelor’s degree in law in July 2012 from the Faculty of Law, Universitas Indonesia, majoring in Commercial Law. During his time in law school, he actively participated in numerous organizations, seminars, trainings courses and events.

He was an active member of Asian Law Student Association (ALSA), participating in ALSA’s international events such as ALSA Conference 2010 in Semarang and Jogjakarta, ALSA Forum 2010 in Seoul, and ALSA Conference 2011 in Singapore.

He was also involved in the establishment of ALSA Alumni Association (ALSA Alumnas).

Before joining Lubis, Santosa & Maramis full time, he worked briefly as an assistant legal researcher in Indonesian Research Center for Anti-Money Laundering (IRCA) and prior to that he also served as an intern at Lubis, Santosa & Maramis Law Firm for three months assisting its Corporate and Commercial Practice Group.

He also served as a Trainee at another premier law firm in Indonesia, working mostly in capital market and M&A matters, during which time he gained experience in assisting the IPO process for one of the largest taxi companies in Indonesia.

His most recent experience includes advising and representing:

  • PT Airbus Helicopters Indonesia with respect to its company regulation and employment issue.
  • Thyssenkrupp Industrial Solutions with respect to agreements related to construction of various infrastructures. 
  • PT Medco Geopower Sarulla with respect to its change of shareholding structure and pledge of shares.
  • PT Airbus Group Indonesia and subsidiaries with respect to their investment-related matters in Indonesia (among others, merger, acquisition, shareholding structure, business restrictions and liaison with Indonesia Investment Coordination Board).
  • PT GMF AeroAsia with respect to its cooperation restructuring with its partners.
  • A real estate and hospitality company against unlawful confiscation in relation to BLBI (Bank Indonesia Liquidity Assistance Fund).
  • A prominent logistics group of companies in Indonesia (representing the group on shareholders' dispute in one of its subsidiaries).

In Lubis, Santosa & Maramis, he is a member of Corporate and Commercial Practice Group, assigned in assisting wide range of national and multinational clients. In Summer 2015, he took a leave to attend Duke University School of Law's Asia-America Institute in Transnational Law in Hong Kong University Faculty of Law.

In his spare time, he likes to travel and read books about Indonesian history. He speaks Bahasa Indonesia, and English.

Tondi Nikita Lubis

T

ondi Nikita Lubis is an associate of the Dispute Resolution Practice Group of Lubis, Santosa & Maramis Law Firm who specializes in civil and commercial litigations. He graduated from the Faculty of Law, Universitas Indonesia (UI) in 2014. During his time in law school, he studied private law and he also participated in numerous national seminars, training courses, and conferences.

Before joining Lubis, Santosa & Maramis Law Firm, Tondi has had numerous internship experiences in various , namely (i) 6 months at Kontras (Komisi untuk Orang Hilang dan Korban Tindak Kekerasan/Commission for “the Disappeared” and Victims of Violence) and (ii) 3 months at Chevron Pacific Indonesia. During his time at KontraS, he was involved in high-profile cases such as assisting in the legal defense of Marry Jane & Rodrigo Gularte, who is under threat of capital punishment and represented Jakarta International School in a Child-Abuse Case. Furthermore, Tondi was also involved in defending the former head of the Komisi Pemberantas Korupsi Official (Anti-Corruption Commission), Bambang Widjojanto & Novel Baswedan in criminal cases allegedly known as “Case Manipulation”. Tondi also participated in the campaign of “kami menolak lupa” (we refuse to forget) for the deceased human rights activist Munir. At Chevron Pacific Indonesia, he learned about production-sharing contracts (SPC), cost recovery, the Foreign Corrupt Practices Act (FCPA), and oil downstream activities.

Early in his carreer at Lubis, Santosa & Maramis Law Firm, he advised and represented clients in various commercial legal disputes, such as PT. Kayung Agro Lestari, PT Berau Coal Energy, PT Premier Resources Indonesia and Coca-Cola Bottling Indonesia. He also part of the team that represented JOB Medco-Pertamina in arbitration proceedings at Indonesian National Arbitration Board (BANI).

Tondi is passionate about soccer and movies. He is actively involved in the “Piala Maya” team, which is an annual award for Indonesia’s best movies. Tondi speaks Bahasa Indonesia and English.
